1) Acceptance of the Terms

These Terms of Service (“Terms”) govern your access to and use of the website, products, and services offered by GK Gadget Store (“we”, “us”, “our”). By accessing or using our Service, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please refrain from using the Service.

2) Eligibility & Account Responsibilities

• You must be at least the age of majority in your jurisdiction (or have parental/guardian consent) to use the Service.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
• Provide accurate information and update it as needed. We may suspend or terminate accounts that contain false, fraudulent, or abusive information.

3) Orders, Pricing & Availability

• Placing Orders: When you place an order, you are making an offer to buy the items listed at the stated price. We may accept or reject orders at our discretion (e.g., for suspected fraud, incorrect pricing, or stock issues).
• Pricing: Prices are shown in INR unless indicated otherwise and may change without notice. Applicable taxes, fees, and shipping charges are displayed at checkout.
• Promotions: Promotions or coupons may have eligibility limits, time windows, and usage caps. We reserve the right to modify or cancel offers.
• Stock & Substitutions: If an item is unavailable, we may cancel the order or offer alternatives or a refund.
• Errors: We strive for accuracy but occasional errors may occur. We may correct errors and cancel orders affected by obvious mistakes (with full refunds where payment has been captured).

4) Payments

We accept major payment methods as listed at checkout (e.g., UPI, cards, net banking, COD where available). By providing a payment method, you represent that you are authorized to use it and authorize us and our payment processors to charge the full amount of your order (including taxes and shipping) to the selected method.

Payments are processed by trusted third-party providers. We do not store full card numbers. Additional verification steps (OTP, 3-D Secure) may be required by your bank.

5) Shipping, Delivery & Risk

We ship via reputable carriers. Estimated delivery dates are provided for convenience and are not guaranteed. Title and risk of loss pass to you upon delivery to the shipping address provided.

6) Returns, Replacements & Refunds

Our goal is to make returns straightforward while protecting hygiene and product integrity. The process, eligibility, and timelines are described in our Refund Policy. By purchasing from us, you agree to follow that policy and the instructions therein (including RMA requirements).

7) Product Descriptions & Compatibility

• We aim to describe products accurately; however, color/finish may vary due to screen or manufacturing variations.
• Compatibility depends on your device and environment. Please verify compatibility before purchase; third-party app limitations are outside our control.
• Minor changes to packaging or accessories may occur without affecting core functionality.

8) License & Acceptable Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes, subject to these Terms. You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes.

9) Reviews & User Content

By submitting reviews, comments, or other content (“User Content”) to the Service, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, adapt, publish, translate, and display such content in connection with the Service and our marketing. You represent that you own or have the necessary rights to the User Content and that it does not violate any law or third-party rights.

We may moderate, edit, or remove User Content that violates these Terms or applicable law, but we are not obligated to do so.

10) Intellectual Property

The Service, including text, graphics, logos, icons, images, videos, and software, is owned by or licensed to GK Gadget Store and protected by applicable IP laws. Nothing in these Terms transfers any ownership rights to you.

11) Privacy & Data

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share information. By using the Service, you consent to our data practices described there.

12) Communications & Electronic Notices

By creating an account or placing an order, you consent to receive transactional emails, SMS (where applicable), and electronic notices related to your orders, account security, policy changes, and service updates. You may opt out of marketing communications at any time using the unsubscribe link or by contacting us.

13) Third-Party Services & Links

The Service may link to or integrate with third-party services (payments, logistics, analytics, social media). We are not responsible for their content, policies, or practices. Your use of third-party services is subject to their terms.

14) Warranties & Disclaimers

Except as expressly provided in writing, the Service and all products are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. You use the Service at your own risk.

15) Limitation of Liability

To the fullest extent permitted by law, GK Gadget Store and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service or products.

Our aggregate liability for any claim shall not exceed the amount you paid for the product giving rise to the claim, or INR 5,000, whichever is lower, unless a higher amount is mandated by law.

16) Indemnification

You agree to defend, indemnify, and hold harmless GK Gadget Store and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any rights of a third party.

17) Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles. Courts located in Bengaluru, Karnataka shall have exclusive jurisdiction, unless otherwise required by law.

18) Suspension & Termination

We may suspend or terminate your access to the Service for violations of these Terms, suspected fraud, security risks, or unlawful activity. You may stop using the Service at any time. Sections that by their nature should survive termination will survive (e.g., IP, indemnity, limitation of liability).

19) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government actions, or internet/service outages.

20) Miscellaneous

• Entire Agreement: These Terms, along with the policies linked below, constitute the entire agreement between you and us regarding the Service.
• Severability: If any provision is deemed invalid, the remaining provisions will remain in effect.
• No Waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment: You may not assign these Terms without our prior written consent. We may assign them as part of a merger, acquisition, or asset sale.
• Headings: Headings are for convenience only and do not affect interpretation.
